FETCH! PET CARE SERVICES AGREEMENT

This Pet Care Services Agreement (“Agreement”) is an agreement between [PET CARE OF COLORADO, LLC] FETCH! PET CARE (“Fetch!”) and you for pet care services.

Fetch! agrees to provide certain pet care services to the Client, including, but not limited to: pet sitting (long term and short term), dog walking, “drop-ins”, pet transportation, feeding and caring for pets, and related pet care services. Client desires to engage Fetch! and its contracted pet sitters and dog walkers to provide pet care services and agrees to the terms and conditions as set forth below:

Terms of Agreement

Term: This Agreement commences as of the Effective Date and shall continue until revoked in writing.

Services: Fetch! agrees to provide certain pet care services to Client as further described herein and as set forth on Exhibit A and in the Client Profile, Pet Profile(s), Veterinary Release form and the Policies and Procedures attached hereto (“Service Request”). Fetch! agrees to provide the services stated in this Agreement in a reliable, trustworthy, and caring manner. In consideration of these services and as an express condition thereof, the client expressly waives and relinquishes any and all claims against Fetch!, its employees or assigns.

Payment Terms: All payments for pet care services will be made through Fetch! Pet Care, Inc.'s website, www.fetchpetcare.com or via Fetch! Pet Care, Inc.'s customer service center.

Three (3) full days' notice is required for cancelation, otherwise 100% of total assignment may be charged. A 50% non-refundable deposit will be required for 3+ days of In-Home Overnight, Private Boarding, and Live In Pet Sitter services.

All scheduling adjustments need to be conveyed to the main office or by logging onto the app.
Scheduling requests made with less than 24hrs notice may require same day surcharge.
First time consultations are otherwise free (with scheduled service) but any subsequent consultations that are requested/required with current/new sitter may require a $20 charge.

Fetch! Employees: Dog walking will be performed only by Fetch! employees during all assignments unless prearranged with a client (i.e. in the event of Fetch! owner or employee being on vacation, illness, etc.).

Security of Premises: Fetch! accepts no responsibility for security of the premises or loss if other individuals have access to the home during the term of this Agreement. Fetch! is not liable for any loss or damage in the event of a burglary or other crime that should occur while under this Contract. Client shall be responsible for securing the home to the fullest extent possible prior to departure. Fetch! will use its best efforts to secure the home upon entry and departure.

Time of Appointment: Client understands and agrees that the amount of time Client books for a dog walk (i.e. 30, 45, or 60 minutes) includes any additional time required by Fetch! to prepare Client's dog(s) for the walk (or clean Client's dog when the walk ends). This includes routines such as placing clothing / booties (outdoor wear) on Client's dog, feedings, cleaning, and any other requests. Further, there may be days when Fetch! arrives earlier or later than the start of Client's scheduled appointment. This may be due to traffic, weather, emergency, etc. Should this occur, Client's dog will always receive the full 30, 45 or 60 minute walk Client has booked regardless of when we arrive for the appointment.


Pet-Proofing Home: Client shall be responsible for pet-proofing the house and yard (including securing all fences, electronic fences or otherwise). It is the pet owner's sole responsibility to “pet-proof” any areas of the home and/or property to which the pet has access. This includes thoroughly inspecting fences, gates, latches, doors and other devices meant to contain the pet or restrict access to specific areas. The pet sitter does not assume responsibility and has no liability for any injuries the pet may sustain or property damage the pet may cause while in its own home/property. Fetch! shall not be responsible for the safety of pet(s) and will not be liable for the death, injury, disappearance or legal consequences of any pet(s) with unsupervised access to the outdoors. Fetch! is not responsible for any damage to the home or property beyond the control of the sitter. In the event of damage to the home or property requiring immediate repair in order to avoid further damage or is necessary, in the discretion of sitter, to be repaired promptly to keep the home or property habitable prior to Client's return, Client agrees to pay for such damage or fully reimburse Fetch! for such costs and expenses as the case may be.

Visitors/Third-Parties: For the safety and well-being of your pet(s) and the security of your property, visitors and third-parties are absolutely not permitted on the Client's premises under the terms of this agreement. Therefore, all parties agree that no other person(s), including Client's friends, family members and other third-party contractors, shall have access to Client's pet(s) and/or property during the dates of service except Fetch! and their representatives. Persons that need to be on the property, will be listed on Fetch!'s Service Request prior to Client's departure. Fetch!'s insurance company may not be liable for any claim of injury, death, damage or loss to Client's pet(s) or property if any third parties are on Client's premises during the term of Fetch!'s pet care assignment.

Injury to Client's Pet(s) by Other Animal(s): Fetch! and its contracted staff will not be responsible for any pet(s) that instigate fights with other animals or is injured by another animal while in the Fetch! care. Fetch! will use its reasonable best efforts and take all reasonably appropriate actions to ensure that Client's pet(s) are not placed in the company of aggressive or violent animals and/or will immediately remove Client's pet(s) from any animal fight.

Injury or Escape of Pet(s): Client and sitter are aware that the highest level of care shall be given to any and all pets under care of the pet sitter employed by Fetch!. Client is aware, and acknowledges, that pet(s) are instinctual in nature and not always controllable by the sitter even when the highest level of care is provided. Should the Client's pet(s) run away or be injured, Client agrees that Fetch! will not be responsible for any liability.

Injury to Pet Sitter or another person by Client's Pet(s): Client will be solely responsible for all medical expenses and damages resulting from an injury to the pet sitter or other persons by the Client's pet(s). Client agrees to pay the full cost of any and all medical expenses and damages should they arise to Fetch!'s pet sitter or the pet sitter's possessions as a result of the Client's pet(s) actions. Client agrees to indemnify, hold harmless, and defend Fetch! in the event of a claim by any person injured by the Client's pet(s).

Unsafe Pet(s): This contract permits Fetch! to use discretion to stop and end service at any time, in Fetch!'s sole and absolute discretion, that Client's pet(s) pose a danger to the safety and health of itself, other pets, other people or Fetch! sitters/walkers.

Pet Illness/Veterinary Care: Client authorizes Fetch! to obtain any emergency veterinary care that may be necessary during the time spent with my pet. Client accepts responsibility for any charges related to this emergency care. Client also authorizes Fetch! to utilize an alternative veterinarian in the event Client's primary veterinarian is unavailable. Every effort will be made to contact Client prior to obtaining emergency care. Client is aware and agrees to the medical costs associated with any issues relating to the pet(s) being ill or otherwise needing veterinary care, which decision to seek such care shall be determined in the sole and absolute discretion of Fetch! or its sitters. Client agrees to pay Fetch! the sum of $40.00 per hour (in addition to any incidental costs related thereto) should the sitter need to take the pet(s) to the vet. Client agrees to reimburse Fetch! for any additional fees for providing emergency care, as well as any expenses incurred for unexpected visits, transportation, housing, food, or supplies.

Licenses/Vaccinations: Client attests to the fact that all licenses and vaccinations required by the state and the city in which Client resides are current according to the law.


We may use a picture of your pet in any one of our social media campaigns. Please advise in writing if you are not willing to authorize this.

Social Media Waiver: Fetch! may photograph Client's pet(s) and use these photos for marketing and promotional purposes without any liability or obligation by Client.

Solicitation of Fetch! Sitters: Client agrees that the pet sitter provided by Fetch! is employed through Fetch! and is contracted to work only through Fetch! and not directly through the individual Client listed above. Client agrees that all reservations for present and future sitting and dog walking must be made through Fetch! and not the individual sitter. Client acknowledges that Fetch! a sitter may give out his/her personal number to the Client. Client agrees to use this number only in the event of an emergency during which the sitter/walker is already employed directly through Fetch! for Client. Client acknowledges that contracting directly through the pet sitter will result in a breach of this Contract and Fetch! will seek, in addition to potential other damages, liquidated damages in the amount of $1,000 per violation.

Indemnification: Client (as "Indemnifying Party") shall indemnify , hold harmless, and defend Fetch! and its managers, officers, directors, employees (including sitters, walkers, or any other person employed in any manner to perform the services herein whether by contract or otherwise), agents, affiliates, successors, and assigns (collectively, "Indemnified Party") against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including professional fees and reasonable attorneys' fees, that are incurred by Indemnified Party/awarded against Indemnified Party in a judgment, or any administrative proceeding, (collectively, "Losses"), arising out of any third-party claim alleging (a) any negligent or more culpable act or omission of Indemnifying Party or its Personnel (including any reckless or willful misconduct) in connection with the performance of its obligations under this Agreement; (b) any bodily injury, death of any person, or damage to real or tangible personal property caused by the negligent or more culpable acts or omissions of Indemnifying Party or its Personnel (including any reckless or willful misconduct); or (c) any failure by Indemnifying Party to comply with any applicable federal, state, or local laws, regulations, or codes in the performance of its obligations under this Agreement.

Client has completed and signed the required Veterinary Release form, Pet Profile, and Client Profile. Any reference to pet(s) in this Agreement shall refer to those specified on the Pet Profile sheet(s).

This agreement will remain valid for current and future service, with the exceptions of any agreed changes in fees or frequency or total number of visits.


Client has read and agreed to the below Policies and Procedures which are incorporated hereto and made part of this Agreement. Client has been provided with a copy for Client's records. By signing below, and/or emailing a written agreement to the terms of Mack6 Enterprises, LLC d/b/a Fetch! Pet Care, the Client agrees that he/she has read this Agreement in its entirety and fully understands and accepts its terms and conditions.

Exhibit A

Services to be provided by Fetch! under this Agreement are explicitly limited to those set forth below. For the avoidance of doubt, Fetch! is not obligated to provide any services other than those expressly listed below. If Fetch! performs any additional services at Client's request, Client will be obligated to pay Fetch! at Fetch!'s normal rate for such services on the terms and conditions as set forth in the Agreement.

Policies and Procedures

Pet comfort and the safety and security of your home are the cornerstones of our business. Fetch! provides pet care for owners who need a helping hand. Whether you go on vacation, a business trip, need a midday visit to walk, feed, cuddle, or medicate your pet, Fetch! can do it when you cannot. Our services are provided in a reliable, trustworthy, and caring manner.

Please note that Policies and Procedures are subject to reasonable changes and amendments, which may be implemented from time to time.

Reservations: Please plan ahead to obtain services on the dates you desire. An in-home consultation is required prior to reservations for all new clients. While we can tentatively pencil in your dates, we must meet you and your pets, and assess your needs before we make a commitment to providing your pets' care. During this initial meeting, we will also review and complete forms and sign agreements. Please complete all forms prior to our initial consultation.

Keys: Fetch! uses a lockbox system to retrieve keys necessary to gain entry into your residence. Lockboxes may be purchased from Fetch! or you may supply your own. If you purchase a lockbox from Fetch!, the cost will be added to your first invoice.

Fetch! reserves the right to deny service or terminate service because of safety concerns, failure to comply with policy, or inappropriate or uncomfortable circumstances.

Visitors/Third-Parties: For the safety and well-being of your pet(s) and the security of your property, visitors and third-parties are absolutely not permitted on the Client's premises under the terms of this agreement. Please notify Fetch! on your Service Request if others (housekeepers, pest control service, realtors, friends, family members, etc.) will have access to your home during your absence. It is understood that the client will notify anyone with access to the home that Fetch!'s services have been engaged. The police will be called on all intruders or suspicious acts without exception.

Fetch!, company owner, agents, assigns, successors and heirs are not liable and are completely indemnified for any and all liability stemming from the act(s) or failure to act of third parties, whether known or unknown, including but not limited to, friends, neighbors, relatives or other service persons, that shall enter your residence for any purpose while Fetch! is caring for your pets.

Emergencies: Everyone has them! Feel free to call if an unexpected need arises; we will make every attempt to accommodate your needs for service on short notice depending on our availability. We will carry a copy of your emergency contact form with our daily log (your name plus contact's name and phone number) in the event we have an unexpected accident or illness. Please be sure this information is current and that the designated contact has access to your home to ensure your pets' care continues uninterrupted.

Inclement Weather: We walk dogs year-round, except for rare instances of extreme, inclement weather, i.e. thunderstorms / lightning, torrential downpours, blizzards, hazardous wind chill, or when the client's usual walk route is made treacherous due to ice or heavy snow.
a) Should we be unable to reach your home due to poor weather conditions, Fetch! will contact you by email to let you know the walk has been cancelled. We will then refund your payment or place a credit for the dog walk back into your account.
b) If we are able to reach your home in inclement weather, we will take your pet(s) out for a brief potty break and spend the remaining time playing indoors.

Unsecured pets: Fetch! will not be responsible for free-roaming or outdoor pets in the event of illness, injury, loss or death. It is strongly advised that all pet(s) have some form of permanent ID and that they remain inside the home or confined to a yard or pen for their own safety and welfare in your absence.
